Final approval for Hartley to remain in Dartford Constituency
(Boundary Commission's website) The Boundary Commission has now completed its review of the parliamentary constituencies for Kent, and confirmed that Hartley is to remain in Dartford Constituency. The new boundaries will be brought in when they have finished reviewing the whole country, which must be before 12 April 2007. This means they will probably not be in force for the next election. Electoral Review of County Council Seats Completed
(Boundary Committee website) The Boundary Committee have been reviewing the boundaries of the seats for county councillors in Kent. At present Sevenoaks district has 8 county councillors, but because of population changes this will be reduced to 7, meaning all the boundaries needed to be redrawn. So for the next election in May 2005 the wards of Hartley and Hodsoll Street, Ash, and Fawkham and West Kingsdown will be one county council division (this is the same as present, but with the addition of West Kingsdown). The Committee rejected the county council's proposals as it would involve splitting wards. The statutory instrument bringing the changes into law is made today.

Wardens "Really Make Difference"
(Dartford Times, p9; additional reporting FHC) KCC announce 10 new community wardens for the Dartford and Sevenoaks area from March 05, including one each for Hartley and Longfield. The KCC press release says "The Kent Community Safety Partnership between KCC and Kent Police aims to reduce crime and fear of crime, to address anti-social behaviour and low level crime and to help build strong communities. Distinctively uniformed and badged, wardens are a very visible presence and focal point for people's concerns."

Sevenoaks refuse Downs Valley Mast Application
(FHC) After hundreds of objections, including one from FHC, Sevenoaks Council have refused the third application by Orange for a telephone mast at Downs Valley. Their reasons were:

  • "The proposed installation, by reason of its siting and design would be seen as a visual intrusion in this rural location within the Green Belt and be detrimental to the character, appearance and openness of the locality", contrary to the local development plans
  • It would detract from residential amenity
  • Threat to trees and vegetation contrary to interests of nature and habitat conservation.

Obituary of Green Party leader, born in Hartley
(Green Party website) Obituary of Dr Mike Woodin. He was born in Hartley in 1965, and later became a don at Oxford University in Psychology. He was the first green councillor for Oxford in 1994 and since then the party has helped to achieve less traffic congestion, 100% recycling and 50% affordable housing. He was for many years one of the party's "principal speakers" (joint leaders). Current leader Caroline Lucas said: "At a time when our elected representatives are increasingly viewed as cynical and self-serving, his political career was an inspiring reminder that honesty, intelligence and humanity can still thrive at the heart of public life."

Euro result puts the Tories on top
(Dartford Messenger, p15, additional reporting by FHC) In the European elections the Conservatives won 4 of the 10 South East region seats, followed by the UK Independence Party and Liberal Democrats with 2 each, Labour and the Greens also took a seat a piece. Each local authority area gave their results separately, the Conservatives will no doubt be pleased to have "won" our Dartford constituency but a general election result will be much closer. Hartley falls in the Sevenoaks Counting area for this election but is likely to be part of Dartford constituency for the general election.

One party that did better locally than regionally were the fledgling English Democrats, who are campaigning for a parliament for England. They fielded a number of local candidates, including Hartley's own Lyndon Newins, a former independent parish councillor.

Hartley remembers D-Day

Parliamentary Boundary Review Recommends Hartley Remains in Dartford
(Kent on Sunday, p62. Additional reporting - FHC) The Boundary Commission has made its final recommendations on the boundaries of the parliamentary constituencies in Kent, following a public enquiry held last November. They now recommend that Hartley and Hodsoll Street ward be part of Dartford Constituency.

The commission initially suggested that the Dartford Constituency should be the borough of Dartford and the Sevenoaks ward of Horton Kirby, South Darenth and Farningham. Hartley and Hodsoll Street was to go into Sevenoaks Constituency. But because of the number of objections to this and other proposals in the county a public enquiry had to be held.

At the public enquiry the three main parties were well represented, constituency boundaries after all being of vital importance to them when it comes to winning them at election time. The (national) Conservatives argued that the Dartford constituency should include both Horton Kirby and Hartley wards. Labour argued the boundary of the Dartford seat should be the same as the borough, which our labour MP agreed with. The Hartley Conservatives (and by extension the parish council) agreed with the Commission's initial proposals. The last option - to include the Hartley ward (instead of Horton Kirby) with Dartford was put forward most forcefully by Dartford Borough Council. The chairman of the enquiry said it "was a model example for all to follow: indeed a paragon. It really was most helpful and persuasive". The FHC were also at the enquiry to argue for Hartley being in Dartford constituency, the commissioner kindly praised the "enormous amount of thorough research" in its "invaluable report". He also called attention to the contribution from 81 year old Hartley resident Mrs Sharp for taking the trouble to come to Ashford to speak.

Boundary reviews have rules that must be adhered to, and the commissioner believed that keeping Hartley in Dartford not only matched the numbers of the two seats better, but also meant less inconvenience in moving people from one constituency to another. The Conservatives and Liberal Democrats gladly agreed with this view, Labour somewhat less so. It should also be noted that no-one from the Horton Kirby ward spoke in favour of being in Dartford constituency, in stark contrast to Hartley.

My victory for the common-law wives left with nothing
(Daily Mail - Peter Allen, p21; additional reporting by FHC) Hartley property involved in landmark legal decision on the rights of common-law partners. Elayne Oxley and Allan Hiscock bought a house at 35 Dickens Close for £127,000 in 1991. The house was in Mr Hiscock's sole name who had paid £60,700 of the purchase price and taken out a mortgage for £30,000, but Mrs Oxley had contributed £36,300 or 28% of the purchase price. They split up and the house was sold for £232,000 in 2001 of which about £40,000 was paid to Mrs Oxley.

Mrs Oxley filed a claim in Bromley County Court, which ruled Mrs Oxley was entitled to a half share of the proceeds of sale and ordered Mr Hiscock to pay her £72,056. Mr Hiscock appealed. The Court of Appeal (Lord Justices Chadwick, Manse and Scott-Baker) disagreed with the County Court judge's findings that just because a house was intended to be owned jointly, that it must have been in equal shares. Indeed Lord Justice Chadwick said "In my view to declare that the parties were entitled in equal shares would be unfair to Mr Hiscock." However they did rule that because Mrs Oxley had made a full contribution to household running costs "it would be fair to treat them as having made approximately equal contributions to the balance of the purchase price" - that is the £30,000 mortgage. Therefore her share becomes 40% and they adjust the county court order accordingly.

Where the judgement is thought to be novel is in the issue of what can be counted as contributions to a share in the ownership in trust law. Up until now only payments towards the purchase price or home improvements had been allowable, but now general household bills may be included too in the calculations.

County Council "constituencies" announced
(Boundary Committee for England) The government body charged with making sure each councillor represents roughly the same number of people has reported for Kent. They propose the council should remain at 84 seats, but because of population changes, Sevenoaks District is only entitled to 7 members instead of 8 at present.

The result of this is that the current seat of Hartley, Ash and Fawkham is expanded to include West Kingsdown also. This was not what the county council wanted, as they proposed that instead of West Kingsdown, we should be joined with Horton Kirby. However the committee did not like this because this would mean splitting two district council wards.

Unfortunately it appears that we will be the second largest ward in Kent because the 2006 population figure supplied to the Committee appears to be over 700 less than both previous projections, and the population as it is now.

Homes in the South East? Get radical
(Estates Gazette, p130-1) Article by Steve Scrivens, who ran an advert in the Times in 2002 proposing a new city for North West Kent. His argument is that "in the near future" some 2 million people will want to live in the south-east, meaning an extra 500,000 houses above what is planned. Even at high 50 houses per hectare density this will mean an area of 77 square miles being required. He thinks "the only area that can accommodate a large new settlement is north-west Kent in the Dartford, Gravesend and Swanley area." He rejects expanding other Kent settlements because it would destroy countryside there. The rest of the article is his ideas of how the houses might be built and run in a "green" way.

Northfield Councillor disqualified

Cuts in local bus services

(Arriva Public Notice) The local bus company Arriva published a new timetable for the 423 bus to Dartford and the 489 bus to Gravesend.

On the 423 route there is little change in buses to Dartford, but the first two buses of the morning from Dartford on Mondays to Fridays (6.13, 6.53) and Saturday (7.26 and 8.25) will no longer run. On the plus side the 17.15 bus from Dartford on a Saturday is now extended from Longfield to New Ash Green.

On the 489 route the 7.38 bus from Gravesend on weekdays, along with the 15.40 from New Ash Green to Gravesend will no longer run. In addition the 8.20 and 15.20 buses from New Ash Green to Longfield will no longer run.
